General terms and conditions of the Kreuzberg-Bonn eV

– Participation in German courses and accommodation services –

Registration, conclusion of contract

You have to register for the course you want as well as any additional accommodation you want in our study house by post or e-mail. We will then inform you in writing within one week whether we can meet your booking request and whether and if so which further information or documents we still need from you.
The contract for participation in the German course and, if applicable, accommodation in our study house is only concluded when we have received your complete registration information and documents and the course and, if applicable, accommodation costs have been credited to our account.

Visa confirmation

You are responsible for the legality of your stay in Germany. After paying the course and, if applicable, the accommodation costs, you will receive a confirmation of registration from us, which you will need to apply for a visa. Please note that for the visa confirmation you must also take out health insurance that is valid for Germany and the duration of your stay here.

Course duration (weekly hours)

In our intensive courses, 30 hours per week (1 lesson hour = 45 minutes) are given. Our courses have a minimum of 5 and a maximum of 14 participants. If the number of participants is less than 8, we reserve the right to reduce the number of weekly lessons to 20. In the case of small group lessons, the associated concentration of the subject matter has no influence on the amount of the course fee.

Teaching material

The course fees include the cost of extensive additional teaching material (worksheets). The cost of textbooks is not included in the course fees; You can purchase these in our institute at the current retail price.

Course extension

You can book follow-up courses with our administration during your stay. In this case, the course and accommodation costs must be paid for the time you want at the latest on the first day of the course of the new level (if necessary, submission of a corresponding bank receipt).

Cancellation of courses, withdrawal, rebooking

If the number of registrations for a German course is less than 5 people, we can cancel the course up to four weeks before the planned start of the course. In this case, paid course fees will be reimbursed.
If you do not take part in the course you have booked or do not want to use the accommodation you have booked, the following cancellation or rebooking conditions apply:
Withdrawal from agreed services (course and / or accommodation) is only possible up to the beginning of the booked course or the booked accommodation period and must be made in writing in any case.
If you withdraw, we will reimburse you for the course and / or accommodation costs you have paid, less cancellation costs . If you withdraw up to 4 weeks before the start of the course or accommodation, this amounts to 15% and in the case of withdrawal within 4 weeks before the start of the course or accommodation, 25% of the canceled services.
Instead of withdrawing from the agreed services, you can – subject to availability – change your booking to the next or the next but one no later than 4 weeks before the start of the booked course or the booked accommodation. In this case, the course and accommodation costs you have paid will be offset against the costs incurred, in this case you will not incur any cancellation costs.
After the start of the booked course or the booked accommodation period, the costs of services not used by you will not be reimbursed. One for which we are not responsible
Course cancellation within the week (e.g. public holidays and Carnival Monday) will not be reimbursed.
If you have already been sent a confirmation of registration for submission to the responsible immigration authority or embassy before you withdraw or change your booking, the original must be returned to us immediately. Otherwise, or in the case of unexcused non-attendance at the beginning of the course, we must inform the immigration authorities.

Liability

The liability of Kreuzberg-Bonn eV and its employees towards you is limited to willful or grossly negligent damage.
The limitation of liability does not apply in the event of injury to life or limb or in the event of a breach of essential contractual obligations. In the event of a breach of essential contractual obligations, the liability of Kreuzberg-Bonn eV is limited to the amount of the foreseeable damage.
Kreuzberg-Bonn eV is not liable for the failure of its services due to force majeure, strikes or other reasons for which it is not responsible.

Data collection and data protection

You declare that you agree to us that we can electronically record the data you have transmitted to us, in particular your personal data, exclusively for the purpose of properly carrying out the registration, billing and performance verification process and to fulfill legal obligations, in particular under the Freigners Act be allowed to process.
You have the right to information about the data we have saved about you. You also have the right to have your data corrected or deleted, insofar as it is not required for the billing and performance verification process and to fulfill legal obligations.

For online participation in our courses, we rely on the US provider “zoom”. We use the so-called “EU” cluster from Zoom. Streaming takes place exclusively in data centers in the European Union. A transfer of personal data to the USA or any other third country does not take place. We have concluded an order processing contract with “Zoom” including the EU standard contractual clauses. We rely on the Swedish provider “exam.net” to carry out our internal exams at the end of each course. Exam.net is based in Sweden including the servers they use. It meets all the requirements of the Swedish National Agency for Education in terms of security, data processing, anonymization and permitted tools. We have concluded an order processing contract with Exam.net. (see also: exam.net )

Certificate

After each exam at the end of a course level you have completed, you will receive a certificate indicating your results in the individual parts of the exam as well as the overall result. The certificate also provides information about the CEFR level of the respective course, the duration of the course and the number of hours of instruction you have completed.
A condition for the issuance of the certificate is regular participation in the course as well as successful completion of the examination. If these requirements are not met, you will receive a certificate of attendance which only states the CEFR level of the respective course, the duration of the course and the number of lessons you have completed.

Other certificates of attendance

If required, we can issue you with additional certificates for submission to universities or other authorities or institutions about participation in the German course we organize. The authority or institution to which the certificate is to be submitted must be named to us and will be expressly noted on the certificate; Only the course hours actually attended up to the date of issue are certified.
We reserve the right to make the issuing of additional certificates dependent on a reimbursement of the costs incurred.

Applicable law, contract language, place of jurisdiction

German law is applicable to the contract concluded with you.
In the event of any discrepancies between the German version of these General Terms and Conditions and foreign language versions, the German text version shall prevail.
Bonn is agreed as the place of jurisdiction.
